City and County of San Francisco vs. Academy of Art
David Millstein and Gerald Richelson settled a decade-long dispute and litigation on behalf of the Academy of Art, concerning 48 properties, resulting in re-zoning and a Development Agreement.
Completed the negotiation and settlement of a decade-long dispute between the City and County of San Francisco and The Academy of Art University relating the permitted uses of the Academy’s properties throughout the City. The Settlement resulted in a Development Agreement, numerous conditional use authorizations, a master permit to alter, and numerous municipal code amendments to legalize the project. The settlement and Development Agreement required and received approval by the San Francisco Planning Department, City Attorney, Historic Preservation Commission, Planning Commission, Board of Supervisors, and Mayor.
Miller v. Merchisen
David Millstein defended a party who was wrongfully accused of defrauding two San Francisco tenants. The case was dismissed after the plaintiffs closed their case.
Kliban v. Dixon
David Millstein obtained a verdict in favor of his client after trial in Marin Superior Court on a boundary dispute which result was affirmed by the Court of Appeals.
Protected homeowner rights in multiple suits against a homeowners association on governance and financial issues.
