ACHP v. CHW
Represented physician groups challenging a $38 million dollar merger between a hospital and a management services organization.
David Millstein represented an association of physician groups formed to challenge a $38 million merger/acquisition, which violated Corporate Practice of Medicine and anti-kickback rules. Against one of the nation’s largest hospital systems, the merger was abandoned in the middle of trial.
American Academy of Emergency Medicine vs. Team Health
Filed and resolved antitrust unfair trade practices suit on behalf of a national physician organization.
Simon Med. v. Dignity Health
Initiated litigation against Dignity Health on behalf of a multi-state radiology practice for breach of contract, resulting in the physician being able to buy back his company.
